Terms & Conditions
Last Updated: November 18, 2025
Introduction
Welcome to BarbellMedia! These Terms and Conditions govern your use of the BarbellMedia website and the purchase of our products. By accessing or using our site, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our website.
This agreement is between you (the customer) and BarbellMedia (referred to as “we,” “us,” or “our”). We specialise in selling gym apparel (physical products) and digital workout programs (digital products), all through one-time purchases (no subscriptions).
Nothing in these Terms affects your statutory rights as a consumer under UK law.
Acceptance of Terms
By placing an order or using any part of our site, you signify your acceptance of these Terms. You acknowledge that you have read, understood, and agree to comply with these Terms and all applicable laws and regulations.
No account creation is required – you do not need to register an account to purchase products on our website. If you do create an optional profile or leave a review, you are responsible for maintaining the confidentiality of any login information.
You also confirm that you are legally capable of entering into this agreement (e.g. you are at least 18, or you have parental/guardian consent). If you violate these Terms or any applicable law, we reserve the right to deny you access to the website.
Products and Services
BarbellMedia offers two types of products:
-
Physical gym apparel (such as shirts, shorts, and accessories)
-
Digital workout programs (downloadable content like e-books or training videos)
All products are sold on a one-time purchase basis; we do not offer any subscription services for recurring charges.
Product Descriptions
We strive to provide accurate and up-to-date descriptions, specifications, and images for all our products. However, we do not guarantee that all information is error-free or complete. For example, colours of apparel may appear slightly different in photos, and digital content descriptions are provided for general guidance. We reserve the right to correct any errors, inaccuracies, or omissions, and to update product information at any time without prior notice.
Product Availability
All products are subject to availability. We may modify, replace, or discontinue any product or service at our discretion, and we will not be liable if any product is out of stock or unavailable. Adding an item to your cart or wishlist does not guarantee that item’s availability at checkout.
Digital Products Delivery
When you purchase a digital workout program, it will be delivered electronically (for example, via an emailed download link or direct download on the site). Digital products are typically made available immediately after successful payment. Ensure you provide a valid email address at checkout so you can receive your digital items.
Digital content is licensed to you for personal use only. You must not share, resell, or distribute digital workout files to others (see Intellectual Property below for more details).
No Subscription Services
Because all sales are one-time purchases, you will not be charged on a recurring basis. Each transaction is a standalone purchase. We do not require any ongoing membership or subscription fees to access your digital programmes or to buy physical products.
Payment Terms
When you make a purchase through BarbellMedia, you agree to the following payment terms:
Pricing
All prices are listed in GBP (£) and are subject to change without notice. We are not responsible for typographical errors or inaccuracies in pricing. In the event of a pricing error, we reserve the right to cancel or adjust your order. There is a chance that prices may change between the submission of your order and its confirmation, though once an order is confirmed, that price will be honoured for that order.
Taxes
Any applicable sales taxes (e.g. VAT) will be calculated and shown at checkout. For international orders, see Shipping and Delivery regarding import taxes or duties. You are responsible for any taxes or fees that apply to your purchase, whether charged at checkout or by your local authorities.
Order Acceptance
Your order is an offer to buy the product(s) from us. All orders placed are subject to our acceptance. We explicitly reserve the right to refuse or cancel any order for any reason at our discretion (for example, suspected fraud, payment issues, errors in product information, or unusually large orders). If we cancel your order, we will refund any payment you have made for that order.
Payment Processing
Payment must be made in full at the time of ordering. We accept standard payment methods such as credit/debit cards and may accept other methods like PayPal or digital wallets as indicated at checkout. Payments are processed by third-party payment providers, not on our servers. This means we do not collect or store your full payment information (such as card numbers) on our system.
For any issues with payment (e.g., a declined card or a payment dispute), please contact your payment provider or bank directly, as they handle the transaction.
Secure Transactions
We implement industry-standard security measures to protect your payment information during transmission. Although we do not store your card details, we ensure that our payment gateway is PCI-DSS compliant. You should only provide payment details through our official checkout page – we will never ask for your payment information via email or chat.
Billing Accuracy
You agree to provide current, complete, and accurate purchase and contact information for all purchases. If any information (such as your billing address or email) changes, please update it promptly so we can complete your transactions and contact you as needed.
Shipping and Delivery
We ship physical products to customers in the UK and internationally. By placing an order, you agree to the following shipping and delivery terms:
Processing Time
We aim to process and dispatch physical product orders as quickly as possible, typically within 1–3 business days. During high volume periods (such as holidays or sales), processing may take a bit longer. We will notify you of any unusually long delays in processing your order where reasonably possible.
Shipping Methods
During checkout, you will be presented with available shipping options (standard, expedited, etc.) based on your delivery address. Shipping fees (if any) will also be displayed at checkout. You can choose your preferred method; however, note that faster shipping options may incur higher fees.
Delivery Times
Delivery times vary depending on your location and the shipping method chosen. Any delivery dates provided are estimates and not guaranteed. International shipments, in particular, may take longer due to distance and customs processing.
We are not liable for delays caused by carriers, customs inspections, or events beyond our control (such as weather, natural disasters, or import delays). However, if you experience a significant delay, please contact us and we will do our best to assist in tracking the shipment.
International Shipping
We proudly ship to many countries worldwide. Buyers are responsible for any customs duties, import taxes, or fees required by their country for importing goods. These charges are not included in our product prices or shipping fees at checkout. If applicable, your local customs agency will assess these fees, and you will need to pay them to receive your package. We have no control over these charges and cannot predict their amount.
We also comply with international shipping laws, so we will accurately declare the value and contents of your package; we cannot mark orders as “gifts” or undervalue items to avoid customs fees. International customers should familiarise themselves with their country’s import rules and fees before ordering.
Packaging and Risk of Loss
We pack our products carefully to ensure they arrive in good condition. For most consumer orders, risk of loss and damage passes to you when you (or someone you nominate) take physical possession of the goods (i.e. on delivery to your address), in line with UK consumer law.
If you choose to arrange your own courier (rather than using one of our offered shipping methods), risk may pass to you when we hand the goods to your chosen courier.
In the rare event your package is lost or damaged in transit, please contact us so we can work with you on a resolution (such as investigating with the carrier and, where appropriate, arranging a replacement or refund in accordance with your statutory rights).
Delivery Address
It is your responsibility to provide a correct and complete shipping address. Please double-check your address during checkout. We are not responsible for packages that are undeliverable or delayed due to an incorrect address provided by the customer.
If a package is returned to us due to an incorrect or incomplete address, we will contact you for an updated address and additional shipping payment, or issue a refund for the product price only (at our discretion).
Digital Product Delivery
As noted, digital products are delivered via electronic means and thus have no shipping cost. If you do not receive the email or link for your digital workout program within a few minutes of purchase, check your spam/junk folder or contact us for assistance.
No Return / Refund Policy
Important – Your Statutory Rights
Under UK law, you may have certain rights to refunds, repairs, or replacements, including:
-
Rights under the Consumer Rights Act 2015 if goods are faulty, not as described, or not fit for purpose.
-
A right to cancel most online purchases within 14 days of receiving the goods or concluding the contract, under the Consumer Contracts Regulations 2013, subject to certain exceptions (including digital content where you have requested immediate access).
Nothing in this section limits or removes those statutory rights.
Our Commercial Policy (Beyond Statutory Rights)
Subject to your statutory rights:
-
We operate a no returns / no refunds policy for change of mind, incorrect size selection, or general dissatisfaction (where the goods are not faulty and your statutory cancellation period has expired or does not apply).
-
We also do not offer refunds for digital content once it has been supplied in accordance with your request for immediate access, as explained below.
Physical Products
We do not generally accept returns or provide refunds for gym apparel or other physical items for change-of-mind reasons, such as ordering the wrong size or simply deciding you no longer want the product, once any applicable statutory cancellation period has passed.
We encourage you to review sizing charts, product descriptions, and reviews before purchase to ensure you select the right item.
However, you may be entitled to a refund, repair, or replacement where:
-
The item is faulty or damaged;
-
The item is not as described; or
-
We are otherwise required to do so under UK consumer law.
If you believe your product is faulty or not as described, please contact us promptly with details and, where possible, photos. We will assess your claim and, if appropriate, offer a repair, replacement, or refund in line with your legal rights.
For UK and certain EU consumers, you may also have a legal right to cancel your order for most goods within 14 days of receipt and obtain a refund (including the standard delivery cost). If you exercise this right, you must take reasonable care of the goods and return them to us in their original condition. Full details of how to exercise any statutory cancellation rights will be provided in your order confirmation or on our website.
Digital Products
We do not provide refunds for digital workout programs once they have been supplied, except where required by law (for example, if the digital content is faulty and cannot be repaired or replaced).
Digital content (such as downloads) is normally subject to a 14-day “cooling-off” period under UK law. However, when you purchase a digital product from us, you will be asked to confirm that you:
-
Request immediate access to the digital content; and
-
Acknowledge that you lose your statutory right to cancel once we start providing the digital content (e.g. when the download or streaming begins).
By confirming these points and accessing the digital content, you agree that your right to cancel under the Consumer Contracts Regulations 2013 is waived once supply has begun.
Please ensure your device is compatible with common file formats (e.g., PDF, Microsoft Excel, video formats) before buying, and feel free to ask any pre-sale questions.
Policy Rationale
Implementing a limited refund policy helps us keep our costs low and combat fraud (for example, preventing the “return” of used or copied digital content). While this policy may seem strict, it is common for businesses that sell digital products or final-sale items to restrict returns. By completing a purchase, you acknowledge and accept this policy, in addition to any non-excludable statutory rights you have.
Intellectual Property
All content and materials on the BarbellMedia website are intellectual property owned by BarbellMedia or its licensors. This includes (but is not limited to) text, graphics, logos, images, videos, design layout, software, and digital products available on the site. These are protected by copyright, trade mark, and other applicable intellectual property laws.
BarbellMedia Branding
“BarbellMedia” and our logos, slogans, and designs are trade marks or service marks of BarbellMedia. You are not granted any licence or right to use any of our trade marks without our prior written permission.
Personal Use Licence
When you purchase a digital workout program from us, BarbellMedia grants you a limited, non-exclusive, non-transferable licence to download and use that content for your personal and non-commercial use only. You do not acquire any ownership rights in the digital content.
Similarly, purchasing physical merchandise does not grant you any rights to reproduce or exploit our intellectual property printed on those items beyond personal use of the product.
Restrictions
You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any content on our website or from our digital products without express written permission from us. This means, for example:
-
You cannot resell or redistribute our workout program files, either in original or altered form.
-
You cannot use our photos or text from the site for your own commercial purposes.
-
You must not remove or obscure any copyright or trade mark notices on our products or website.
User Obligations
You agree not to infringe on our intellectual property rights or the rights of any third parties. Any unauthorised use of the content may violate copyright laws, trade mark laws, privacy and publicity laws, and/or communications regulations and statutes. We reserve the right to take legal action in the event our intellectual property rights are violated.
Feedback
If you choose to provide feedback, suggestions, or ideas to us (for example, improvements to products or the website), you agree that we can use and implement that feedback without restriction or compensation to you. Any such submissions are considered non-confidential and non-proprietary.
User-Generated Content (Product Reviews)
Our site may allow customers to submit product reviews or other user-generated content (“UGC”). By posting a review or any content on our site, you agree to the following terms regarding UGC:
Ownership and Licence
You retain ownership of the content you post; you are the owner of your reviews. However, by submitting or posting a review on BarbellMedia, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, publish, translate, display, and distribute your content (in whole or in part) and to incorporate it in other works in any form, media, or technology as needed to operate our site and business.
This licence allows us, for example, to display your review on our product pages, use excerpts in our marketing materials or social media, or reformat it for presentation. You also agree that we may use your review alongside your provided display name or any avatar (if applicable), and that we have the right to moderate or remove your content as described below.
Your Responsibilities
When you post a review or comment, you promise that:
-
You are the author of the content and own all rights to it, or you have permission from the rightful owner to post it. The content is your original work and does not plagiarise others.
-
Your content is truthful and based on your actual experience with the product. Reviews should be relevant to the product in question and provide genuine insight for other customers.
-
Your content does not violate any third-party rights, including copyrights, trade marks, privacy rights, or publicity rights. Do not post anything you do not have the rights to use.
-
Your content complies with these Terms and all applicable laws.
Prohibited Content
Users must not post any content that is illegal, offensive, or inappropriate. Specifically, when writing reviews, do not include:
-
Any language or material that is defamatory, abusive, harassing, hateful, racist, sexist, discriminatory, or inflammatory.
-
Obscene or profane content, or content containing pornography or graphic violence.
-
Personal attacks on any individual or personal information (e.g. do not reveal someone’s full name, phone number, address, or email in a review).
-
Spam, advertising, or self-promotion for unrelated products or services.
-
Malicious code, viruses, or links to harmful sites.
-
Content that is unrelated to the actual product being reviewed (stay on topic about the product).
-
False or misleading information.
We reserve the right not to publish, or to remove, any user content that we deem to violate these standards or that we find otherwise objectionable. Reviews should focus on the product itself; if you have feedback about our customer service or the website, please contact us directly rather than using a product review for those comments.
Moderation and Removal
BarbellMedia reserves the right to monitor, edit, or remove user-generated content at any time at our sole discretion. User reviews are subject to moderation – this means your review might not appear immediately until it is checked for compliance with these Terms.
We may refuse to post or may remove any review that violates our guidelines or policies, or for any reason we deem appropriate. This can include content that is off-topic, violates someone’s rights, contains the prohibited content mentioned above, or if we suspect the review is fake or not from a genuine customer. We may also terminate or suspend a user’s ability to post content if they repeatedly violate these rules.
No Endorsement
Any user-generated content on our site (including product reviews) reflects the opinions of individual users and does not reflect the opinions or positions of BarbellMedia. We do not endorse or guarantee the accuracy of any review content posted by customers. You rely on user reviews at your own discretion and risk.
Reporting Issues
If you believe someone’s user content is violating these Terms or your rights (for example, you think a review infringes your copyright or is defamatory), please notify us using the contact information in the Contact Information section below. We will investigate and take appropriate action, which may include removing the content and/or banning the user, if warranted.
By submitting a review or any content, you also agree to our Privacy Policy (regarding how we may use personal data in connection with UGC). We value honest feedback and aim to maintain a helpful, respectful community through these guidelines.
Limitation of Liability
Use of our website and products is at your own risk. BarbellMedia provides the website, its content, and all products on an “as is” and “as available” basis, without any warranties of any kind unless explicitly stated otherwise.
We make no guarantee that the content on our site (including product descriptions or instructional materials) is 100% accurate, complete, or current, and we make no warranty that the website will be error-free or uninterrupted in operation.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Limitation of Damages
To the maximum extent allowed by applicable law, BarbellMedia will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website, your purchase or use of any products, or any breach of these Terms.
This limitation of liability applies to any damages or losses, whether in contract, tort (including negligence), strict liability, or any other theory, even if we have been advised of the possibility of such damages. For example, we are not liable for losses such as: loss of revenue or profit, loss of data, downtime costs, loss of goodwill, or the cost of substitute products or services.
Maximum Liability
In all cases, BarbellMedia’s total cumulative liability to you for any claim or dispute arising out of your use of the site or purchase of products is limited to the amount you paid to us for the product(s) in question. If the claim does not relate to a specific product, our liability is limited to the total amount you have paid to us in the past six months.
This limitation is a core part of our agreement; we would not be able to offer our products to you on these terms without it.
Specific Application – Fitness Products
BarbellMedia sells fitness-related products (apparel and workout programmes).
Health and Exercise Disclaimer:
Digital workout programs offered by BarbellMedia are for informational purposes only. Before starting any new exercise regimen, especially if you have any pre-existing medical conditions or concerns, consult with a physician or certified fitness professional.
By using our workout programs, you acknowledge that physical exercise carries inherent risks of injury or soreness. You assume full responsibility for your health and safety when following our programmes.
BarbellMedia is not liable for any injuries, health issues, or damages that result from your use of our workout plans or fitness products, to the extent permitted by law. Always use common sense and listen to your body – stop exercising if you feel pain or dizziness and seek medical advice if needed.
No Liability for User Conduct
We are not responsible for the actions of other users or third parties. This includes any harmful content a user might post (see User-Generated Content above) or issues arising from third-party services (like our payment processor or shipping carriers).
Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. If those laws apply to you, some of the above limitations may not apply to the extent prohibited by law.
In particular, nothing in these Terms is intended to exclude or limit liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded by law.
Where we cannot exclude liability, we will limit our liability to the fullest extent allowed by law.
You acknowledge that the limitations of liability and warranty in these Terms are fair and reflected in the prices of our products, which would likely be higher if we had to assume more risk. This section will survive termination of your use of the site or any agreement between you and BarbellMedia.
Governing Law
These Terms and Conditions and any disputes arising from your use of the site or purchase of products are governed by the laws of England and Wales, without regard to its conflict of law principles. By using our services, you agree that the laws of this jurisdiction will apply to any matters related to these Terms.
We recognise that you may be accessing our site from a location outside of our base country; however, the relationship between you and BarbellMedia is governed by the law of England and Wales.
If you are accessing the website from outside the UK, you agree that your use of the site is subject to UK laws. Please note that you may also have certain mandatory rights or protections under the law of the country where you reside; these Terms are not intended to override those local laws when they apply.
Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales. You consent to the personal jurisdiction of such courts and waive any objections (such as inconvenience of forum) to the handling of disputes in those courts.
If you are a consumer in the UK or EU: this Governing Law clause does not deprive you of any protection under the law of the country where you reside. Disputes may be resolved in the courts of that country as appropriate, and you may have rights under EU/UK consumer laws that supersede some terms herein. But in the absence of any such overriding law, the law and courts of England and Wales will apply.
